Chancellor has imposed a 70% tax on assets in
Alternatively Secured Pensions that are passed on to
dependants on death. This is on top of 40% inheritance
tax, making an effective rate of 82%.

The Loss of Tax-Deferred Income?

Ever since the Sandler report recommended the abolition
of the Section 739 friendly policies, the Chancellor has
been threatening to remove the 5% deferred tax rule.
Whilst not mentioned in the pre-budget report, there are
fears in the industry that Gordon Brown may look to
abolish section 739 friendly policies sooner
rather than later.

Bare Trusts no longer
tax-efficient where Children are the Beneficiaries

trusts have become ’fashionable’ in financial planning circles.
However, changes to bare trusts proposed in the Chancellors
pre-budget report mean that they will no longer be an efficient

inheritance tax rose by 72% in the five years up to 2004,
according to a study.

Changes to UK Trust Laws

Further to our update last month on the changes to trust law in
the UK, the Finance Bill received Royal Assent on 19 July and is
now the Finance Act. As a result of this, all life assurance
policy trusts established on or after 22 March 2006, with a few
relatively minor exceptions (mainly bare trusts), will be within
the relevant property regime.
